By visiting our site and/or purchasing something from us (including orders not placed directly via the website), you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Online Store Terms
By agreeing to these Terms of Service, you represent that you are at least the age of maturity in your country of residence, or that you are the age of majority in your country of residence and you have given us your consent to allow any of your minor dependents to use this site. You may not use our products for any illegal or unauthorised purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Terms will result in an immediate termination of your Services.
We reserve the right to refuse service to anyone for any reason at any time.
You understand that your content (not including credit/debit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit/Debit card information is always encrypted during transfer over networks. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us. We aim to despatch all orders within 48 hours, and for deliveries to be completed within 14 days of receipt of payment. When this aim cannot be met for whatever reason, Midlands PPE Ltd will keep you regularly informed and updated regarding the status of your order.
Midlands PPE Ltd will endeavour to meet any delivery date quoted but delivery dates are given and intended as an estimate only. If there are any circumstances whatsoever which prevent or delay delivery, Midlands PPE Ltd shall not be bound to supply or make delivery of any goods ordered nor shall it be liable for any damage or consequential loss or in any other way for failure to supply or delay in delivery when so prevented or delayed.
Whilst we endeavour to ship will items within 48 hours, there will be exceptions to this where an item is out of stock or if an item is made to order. You will b notified by email if an item on your order may not arrive within 14 days of ordering and we will provide a due date for the stock to be delivered to you.
For delivery costs, please contact us directly or see the current price list with delivery details online. All goods must be inspected immediately on arrival. Under no circumstances shall Midlands PPE Ltd be liable for damage to or from our customer unless Midlands PPE Ltd is notified within three days of receipt of goods or in the case of non-delivery unless notice is given within seven days of the due date of arrival.
Accuracy, Completeness and Timeliness of Information
We are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk. This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.
We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any colour will be accurate.
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.
Accuracy of Billing & Account Information
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per business or per order. These restrictions may include orders placed by or under the same customer account, the same credit/debit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit/debit card numbers and expiration dates, so that we can complete your transactions and contact you as needed. Full payment is due within 30 days of invoice. All claims for shortages, damages etc must be made within 3 days of receipt of goods.
Please note that all goods remain the property of Midlands PPE Ltd until payment is received in full.
Failure to comply with the above terms may result in onward referral to an external collection agency for recovery of debts. Their fees and commission will be added onto the total debt owed to Midlands PPE Ltd.
We may provide you with access to third-party tools over which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s). You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you. In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. Wholesale pricing is applied for volume orders on particular items. Midlands PPE Limited may, on occasion, dispatch these orders in parts. These orders may arrive on pallets. If you do not have a loading bay then it remains your responsibility to inform us of this at the time of purchase so that we are able to arrange a vehicle with a tail lift and pump truck to deliver your goods. Please note that packaging for wholesale orders may not be identical to retail orders of the same product - they may arrive in pallet boxes. Custom branding (and insertion of your leaflets, promotional material etc) is available, along with packaging in carton sizes of your choosing for an additional cost - please contact us directly for this.
If you are reselling our products, the Minimum Retail Price is 5% above our list price for that item at that volume at any given time. Please note that prices are subject to change at any time, without notice. It is your responsibility to check our website periodically for changes to ensure you are complying with our Minimum Retail Pricing structure at all times. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes. Permission for special event discounts/sale below the above stated Minimum Retail Price must be requested in writing and approved by Midlands PPE Ltd prior to the promotion going live. In the event the wholesale account chooses to place the items for resale below the above Minimum Retail Price or without approval for a special promotion, Midlands PPE Limited reserves its right to reclaim the difference from the wholesale account holder for breach of these terms.
Products correctly supplied by the company and returned by the customer within the above timeframes will incur the following charges:
15% Handling charge & Restocking fee. For part order returns this is 15% of the purchase price for the items being returned, with a minimum fee of £25. This is to cover our administrative costs associated with the cancellation/amendment, for our staff to check every item returned and to determine whether the items can be re-sold before restocking them.
4% transaction charge. This is to cover bank charges for receiving and refunding payments.
Any refund will be net of the purchase price less the aforementioned charges.
Cancellation & Refund Policy
When you buy goods from a business, in law you have a number of rights. These include the right to claim a refund, replacement, or repair where the goods are faulty or not as described. All claims for damages etc must be made within 3 days of receipt of goods. There will be no restocking fees in these instances.
In addition to your legal rights, we will also allow you to return goods within 14 days from the the date you receive your goods for any reason, even if you simply change your mind. Please contact us within this 14 day period so that we can initiate the return process for you. We need to receive the goods back within 14 days of this notification. We will process your refund less any restocking fees within 14 days of receiving the goods back.
Please note that we are unable to accept any refunds, returns or exchanges for open boxes or packets, unless the refund or exchange is due to faulty goods as above. For example a box of 20 x 3M Aura FFP3 1863+ must be returned as a full box of 20 masks in order to be eligible for a refund. If part of a volume order is returned, the purchase price will be recalculated at the retail cost of the order you are not returning as it was at the original time of purchase, prior to deduction of any aforementioned fees. For example if 6 boxes of 20 x 3M Aura FFP3 1863+ were ordered to avail the bulk order discount, and you wished to return 4 of the boxes, the purchase price will be recalculated as if you had bought the 2 boxes you are not returning at full retail price, prior to deduction of any aforementioned fees. The same rules apply to wholesale orders.
As Midlands PPE Limited is a B2B operation (Business to Business), Midlands PPE Limited is not obliged in any way, shape, or form to offer refunds, returns, exchanges or cancellations notwithstanding the above.
All cancellations or returns or refunds are at the discretion of Midlands PPE Limited and its employees, directors, or its delegates. Midlands PPE Limited are only obliged to offer refunds, cancellations, or returns if the items that you have purchased are either not as described at the point of sale or are damaged/defective. Refunds and returns will only be offered after an internal review has been conducted of the returned items. This review may take up to 14 days plus any processing time for the refund to be completed (up to 14 days).
Refunds on returned items will not include the original shipping price or the price that you paid to ship the item back to us. Due to the nature of the items and in the interest of hygiene, we are only able to accept refunds on unboxed, unworn & unused items that remain in their original packaging.
The cost of returning goods must be paid by the customer and all goods must be returned in original packaging and must be suitably packed in an outer cover to prevent damage during transit.
Unless we have agreed to collect, please return the goods in a double walled cardboard box with bubble wrap/similar by courier, at your own risk and insurance. Midlands PPE Ltd do not accept any responsibility for any goods lost in transit.
Refunds will not be issued without the prior agreement of Midlands PPE Ltd & will usually take the form of a credit note against your account.
